Family proceedings and the principle of therapeutic jurisprudence: Defining the procedural status of specialists

Abstract

Disputes arising from family law relations are inextricably linked to the best interests of the child and the psychological well-being of the family. Consequently, resolving these disputes through the adversarial principle of standard civil procedure is often ineffective and risks inflicting secondary psychological trauma on children. This study investigates the legal status of specialists within the draft law "On the Adjudication of Family Cases," designed for the newly establishing specialized Family and Children's Court in Mongolia, by comparing it against the fundamental principles of civil procedure and grounding the analysis in the conceptual framework of "Therapeutic Jurisprudence."
Statistical data from court-annexed mediation and judgment enforcement verify that the traditional adversarial approach inflicts secondary psychological trauma on children, underscoring the critical necessity of integrating socio-psychological professionals into court proceedings.
However, the draft law defines these professionals using the term "Expert", a role subject to strict regulations under the Law on Civil Procedure and the Law on Forensic Science. This classification conflicts with foundational procedural principles (the adversarial principle, free evaluation of evidence, and expert independence), thereby creating a risk of legal ambiguity. Accordingly, by analyzing judicial statistics from the past five years and conducting a comparative study of the "Family Consultant" institution within the court systems of Australia and Singapore, this research aims to propose solutions to resolve potential discrepancies between the terminology in the draft law and the Code of Civil Procedure.

Хураангуй: Гэр бүлийн эрх зүйн харилцаанаас үүдэлтэй маргаан нь хүүхдийн дээд эрх ашиг, гэр бүлийн сэтгэл зүйтэй салшгүй холбоотой байдаг онцлогтой тул түүнийг ердийн иргэний хэрэг хянан шийдвэрлэх ажиллагааны мэтгэлцэх зарчмаар шийдвэрлэх нь үрдагавар муутай, хүүхдэд хоёрдогч сэтгэл зүйн гэмтэл учруулах эрсдэлтэй байдаг. Энэхүү судалгааны ажлаар Монгол Улсад шинээр байгуулагдах Гэр бүл, хүүхдийн хэргийн дагнасан шүүхийн үйл ажиллагаанд зориулан боловсруулсан Тэр бүлийн хэрэг шүүхэд хянан шийдвэрлэх тухай" хуулийн төсөл дэх мэргэжилтний эрх зүйн байдлыг Иргэний хэрэг хянан шийдвэрлэх ажиллагааны суурь зарчмуудтай харьцуулан, "Эдгэрүүлэх зүй ёс" (Therapeutic Jurisprudence)-Hbi зарчмын үзэл баримтлалд тулгуурлан судалсан болно.
Уламжлалт мэтгэлцэх зарчим нь хүүхдэд сэтгэл зүйн хоёрдогч гэмтэл учруулдаг болохыг шүүхийн эвлэрүүлэн зуучлал болон шийдвэр гүйцэтгэлийн статистик тоо баримтууд нотолж байгаа бөгөөд шүүхэд нийгэм-сэтгэл зүйн мэргэжилтний оролцоо зайлшгүй шаардлагатай байна.
Гэвч хуулийн төсөлд уг мэргэжилтнийг Иргэний хэрэг шүүхэд хянан шийдвэрлэх тухай хууль болон Шүүх шинжилгээний тухай хуулийн хатуу зохицуулалт бүхий "Шинжээч" хэмээх нэр томьёогоор хуульчилсан нь процессын эрх зүйн суурь зарчим (мэтгэлцэх зарчим, нотлох баримтыг чөлөөтэй үнэлэх, шинжээчийн хараат бус байдал)-тай зөрчилдөж, хууль хэрэглээний хийдэл үүсгэх эрсдэлтэй байна. Иймд тус судалгаагаар шүүн таслах ажиллагааны сүүлийн 5 жилийн статистикт дүн шинжилгээ хийж, Австрали, Сингапур Улсын шүүхийн тогтолцоо дахь Тэр бүлийн зөвлөх"-ийн институтийг харьцуулан судлах замаар хуулийн төсөл дэх нэр томьёо болон Иргэний хэрэг шүүхэд хянан шийдвэрлэх тухай хууль (ИХШХШтХ) хооронд үүсэж болох зөрүүтэй байдлыг арилгах арга замуудыг санал болгохыг зорилоо.

Түлхүүр үг: Эдгэрүүлэх зүй ёс (Therapeutic Justice), мэтгэлцэх зарчим, гэр булийн зөвлөх, гэр бүлийн нөхцөл байдлын шинжээч, хүүхдийн дээд эрх ашиг.
