National Security Legal Frameworks: Comparative Analysis and Mongolia

Abstract

The contemporary international security environment has evolved beyond the traditional militarypolitical paradigm and has assumed an expanded and integrated character encompassing economic, energy, cyber technological, infrastructural, and human security dimensions. This transformation has generated a systemic need to reform and modernize the legal framework governing national security. This article comparatively examines the legal regulation and developmental trends of national security by analyzing the institutional and strategic policy experiences of the United States and the Federal Republic of Germany. The study identifies that strategic competition among states, economic interdependence, and vulnerabilities arising from technological transformation have necessitated an expanded substantive scope of national security law. It further delineates the pressing challenges faced by Mongolia in aligning its legal and policy framework with contemporary security realities, particularly in relation to its geostrategic location, economic structure, dependence on energy and infrastructure systems, and the current state of cyber security regulation.

Үндэсний аюулгүй байдлын эрх зүйн орчин: харьцуулалт ба Монгол Улс

Орчин үеийн олон улсын аюулгүй байдлын орчин нь уламжлалт цэрэг-улс төрийн ойлголтоос давж, эдийн засаг, эрчим хүч, кибер технологи, дэд бүтэц, хүний аюулгүй байдлыг хамарсан өргөтгөсөн, нэгдмэл шинжтэй байна. Энэхүү өөрчлөлт нь үндэсний аюулгүй байдлыг хангах эрх зүйн орчныг системийн түвшинд шинэчлэх шаардлагыг бий болгож байна. Тус өгүүлэлд үндэсний аюулгүй байдлын эрх зүйн зохицуулалт, хөгжлийн чиг хандлагыг харьцуулж АНУ болон ХБНГУ-ын аюулгүй байдлын институцийн болон стратегийн бодлогын туршлагыг судлан үзлээ. Улс орнуудын стратегийн өрсөлдөөн, эдийн засгийн хамаарал, технологийн өөрчлөлт бүхий эмзэг байдал нь үндэсний аюулгүй байдлын эрх зүйг агуулгын хүрээнд өргөжүүлэн судлахыг тодорхойлсон. Мөн Монгол Улсын геостратегийн байршил, эдийн засгийн бүтэц, эрчим хүч болон дэд бүтцийн хараат байдал, кибер аюулгүй байдлын эрх зүйн зохицуулалтыг өнөөгийн түвшинд нийцүүлэн тулгамдаж буй сорилтуудыг тодорхойлсон болно.
